We are not responsible for any delay or failure in removing such content. If you use/post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
h. We do not assume any liability for any content used/posted by you or any other 3rd party users of our website. However, any content used/posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of Brighter Day Therapeutic Solutions/altheasimpson.com, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
Privacy
Your privacy is very important to us, which is why we have created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Limitation of Warranties
By using our website, you understand and agree that all Information and Resources we provide are “as is” and “as available”. This means that we do not represent or warrant to you that:
i) the use of our Information and Resources will meet your needs or requirements.
ii) the use of our Information and Resources will be uninterrupted, timely, secure or free from errors.
iii) the information obtained by using our Information and Resources will be accurate or reliable, and
iv) any defects in the operation or functionality of any Information and Resources we provide will be repaired or corrected.
Furthermore, you understand and agree that:
v) any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
vi) no information or advice, whether expressed, implied, oral or written, obtained by you from Brighter Day Therapeutic Solutions, any of it’s entities, or through any resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.
vii) you will not disparage Brighter Day Therapeutic Solutions, Althea T. Simpson, brickmagic.net, any of its entities, or employees in any way, or post any negative statements, reviews, comments, or feedback about the company or services provided to any third party whether orally or in any written publication or online forum, chat room, or message board, including but not limited to Facebook, Twitter, Scam Report and Yelp.
Limitation of Liability
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Brighter Day Therapeutic Solutions nor its entities or representatives will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

UNLESS OTHERWISE EXPRESSED, Brighter Day Therapeutic Solutions/brickmagic.net EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Refunds
All Brighter Day Therapeutic Solutions/brickmagic.net packages, services and products are non-refundable. If you are not satisfied with your purchase, please contact us so that we can work to resolve the situation.
Subscriptions
All subscriptions are non-refundable. If you switch to a new subscription the old subscriptions amount will be prorated for the days that old subscription was use and the new subscription will start on the date of purchase.
Scope of Work and Agreement
Agreement
This Brick Magic Agreement is made by and between Brighter Day Therapeutic Solutions/brickmagic.net, with its principal place of business at 12781 Darby Brook Court, #202, Woodbridge, VA 22192, and the purchaser (“User”). Whereas User desires to subscribe to professional and/or personal development services for User as described in the Scope of Work. Whereas Althea T. Simpson desires to undertake the development content and materials and agrees to do so. Now, therefore, for good and valuable consideration, the parties agree as follows:
Non-Disparagement
You (the User) will not disparage Brighter Day Therapeutic Solutions., brickmagic.net, Althea T. Simpson or any of its entities or employees in any way, or post any negative statements, reviews, comments, or feedback about the company or services provided to any third party whether orally or in any written publication or online forum, chat room, or message board, including but not limited to Facebook, Twitter, Ripoff Report and Yelp.
Parties agree that it would be impracticable and extremely difficult to ascertain the amount of actual damages caused by a failure to comply with this provision. Parties agree that in the event it is established that Client has filed to comply with this provision, liquidated damages of $15,000 for each incident shall be payable.
Payment
The total price for any brickmagic.net products or services will be due prior to any work commencing. Each party represents and warrants that on the date of payment they are duly authorized to bind their respective principals. When Client pays for the service, they are confirming that they agree to the terms of this agreement. We reserve the right to increase the price for products and services that consistently exceed the agreed upon length or are requesting more challenging services or special directions from the User. User will be notified 30-days in advance of any product, services or price changes.
